Medicare Subrogation Obligations of Attorney and Claimants

Michigan No-Fault
The Michigan Supreme Court reversed its 2004 Kreiner decision on July 31, 2010 in McCormick v. Carrier. The new decision re-opens the door to third party tort claims for persons suffering serious impairment of bodily function, death, or permanent serious disfigurement as a result of motor vehicle accidents. The McCormick decision applies a plain reading of the No-Fault statute which replaces the nearly impossible burden of proof required under Kreiner. If you were injured in a Michigan accident, you may have a claim for damages above and beyond the No-Fault PIP benefits. Cubbon & Associates has attorneys who are licensed to and do practice law in Michigan - give us a call and we can assist you in sorting through your options.
