Michigan No-Fault
The Michigan Supreme Court reversed its 2004 Kreiner decision on July 31, 2010 in McCormick v. Carrier. The new decision re-opens the door to third party tort claims for persons suffering serious impairment of bodily function, death, or permanent serious disfigurement as a result of motor vehicle accidents. The McCormick decision applies a plain reading of the No-Fault statute which replaces the nearly impossible burden of proof required under Kreiner.
