Cubbon and Associates attorney Jim Yavorcik argued successfully on behalf of client Tim Berta in a case decided recently by the Ohio Supreme Court over the bus crash involving the Bluffton University baseball team. The Court ruled (5-2) that the driver of the charter bus was covered under a policy issued to the university because the University "hired" the bus and the driver was operating it with the University's permission at the time of the crash. Earlier this month, the Court refused to reconsider the ruling. The effect of the decision is to create a pool of $21 million dollars to cover the claims of 33 passengers on the bus. Seven persons, including the driver were killed in the crash and many were seriously injured Jim and another Toledo lawyer argued the case in the Ohio Supreme Court on behalf of the victims and their families.
