STUART F. CUBBON, a Board Certified Civil Trial Advocate, is a partner and president of Cubbon and Associates. With over 40 years in practice, he is admitted to the Ohio, Michigan, Florida and federal bars. He has represented individuals in wrongful death, auto accident, medical and nursing home and legal malpractice cases as well as other areas of negligence.


Honors and recognitions include board certification by the National Board of Trial Advocates and membership in the prestigious Million Dollar Advocates Forum. He has also been named a Super Lawyer by Ohio Super Lawyers magazine in from 2008 through 2022, consistently rated AV (the highest possible rating) by Martindale-Hubbell, a peer-rated evaluation considered the gold standard in legal evaluations, he also has received a 10/10 rating from Avvo legal rating system and has received the National Trial Lawyers Top 100 Lawyers award from 2011 to the present. In October 2019 Mr. Cubbon received the 2019 Distinguished Toledo Lawyer Award from the University of Toledo Law Alumni Affiliate. In December 2021 he received the Toledo Bar Association's Robert A. Kelb Distinguished Service Award, its highest recognition for service to the Association and its membership.


Mr. Cubbon is proud to be a past president of both the Toledo Bar Association and the Toledo Bar Association Foundation. Stu actively participates in a number of professional organizations, including the Ohio State Bar Association, the American Bar Association, the Michigan Bar Association, the Florida Bar Association, the Morrison R. Waite Chapter of the American Inns of Court, and the National Conference of Bar Presidents.


From 2010 to 2019 Mr. Cubbon served on the Board of Trustees of the Law and Leadership Institute, LLC, a statewide pipeline diversity initiative designed to provide high school students from underserved communities with the tools necessary to excel in high school so that they can be successful in college, and ultimately enter the legal profession. He has also been an active member of the Toledo Bar Association's Diversity Committee for over 12 years, striving to make our profession more diverse and inclusive. 


He also serves as a board member of the Ohio Association for Justice Foundation (formerly named the Ohio Legal Assistance Foundation or OLAF).


He is also a member and Committee Chair of the Ohio Association for Justice.


Outside the practice of law, Mr. Cubbon participates in a number of civic organizations. He is a past president of the University of Toledo Alumni Association. He is a member of Gesu Church.


Mr. Cubbon is married to Lucas County Juvenile Court Judge Denise Navarre Cubbon and they are the proud parents of four children: Jocelyn (Billy) DeMars, Stuart (Christine) Cubbon, Jr., Natalie (Kevin) Crotte and Phillip (Marisa) Cubbon. He is also extremely proud of his eight grandchildren. He is the son of firm founder, Frank W. Cubbon, Jr.

JAMES E. YAVORCIK is a partner at Cubbon and Associates and has been with the firm since 1987. He was admitted to practice in Ohio in 1979 and is also admitted in the Michigan and Federal courts. Jim is board certified as a Civil Trial Advocate by the National Board of Trial Advocacy.


Prior to joining Cubbon and Associates, Jim, was an assistant Lucas County prosecutor, and also has been appointed special prosecutor by the Van Wert and Lucas County Common Pleas Courts on fraud and homicide cases. He was appointed as special counsel by the U.S. Bankruptcy Court in 2013 to pursue complex professional negligence claims on behalf of the U.S. Bankruptcy Trustee. Jim is a past president of the Toledo Bar Association and the Toledo Area Trial Lawyers Association. He formerly served as a Trustee for the Ohio Association of Justice and is a member of the American Association for Justice. He is also a member of the Ohio State, Lucas County, and Michigan bar associations. Jim is a member of the Million Dollar Advocates Forum and is listed in The Best Lawyers in America. He was selected as one of the top 100 trial attorneys in Ohio by the National Trial Lawyers and has been listed as an Ohio Super Lawyer in the field of personal injury law for the past 12 years.


Jim has been selected by his peers to be included in the most recent edition of The Best Lawyers in America in the area of Personal Injury Litigation-Plaintiffs and was named the Toledo Lawyer of the Year in the personal injury field in 2017 and 2021.


As part of the firm's commitment to continuing legal education, Jim has lectured extensively across Ohio on topics including jury selection, evidence, medical malpractice, settlement negotiation, and professionalism. He has extensive trial and appellate experience, including oral argument before the Ohio Supreme Court on an insurance coverage dispute stemming from a bus crash involving the Bluffton University baseball team.


When not practicing law, Jim can be found practicing guitar and bass and has played with various musical groups in Toledo. He also enjoys golfing and following the Ohio State Buckeyes.


Jim is married to Barbara Culpert Yavorcik, an electrical engineer who has been recognized for her advocacy efforts on behalf of autistic individuals in Ohio. They have two grown children, and two granddaughters.

PHILLIP S. CUBBON


Associate Attorney


PHILLIP S. CUBBON is an associate attorney at Cubbon & Associates. Phillip represents individuals in wrongful death actions, automobile and trucking crashes, and other areas of negligence. Phillip is third generation plaintiff's personal injury attorney who feels privileged to have the opportunity to fight for clients who have been wronged or injured by other individuals or corporations. Prior to entering law, Phillip worked in the trucking industry.


Phillip is an active member of the local legal community and is proud to practice the "Toledo Way of Law." He serves on the executive committee of the Lucas County Bar Association and is a member of the Toledo Bar Association's newsletter committee.


Phillip and his wife Marisa are proud residents of the the Historic Old West End. When Phillip isn't practicing law, he enjoys running, playing squash, cooking, and walking his border collie Dash.

 

A native Toledoan, Phillip is the grandson of firm founder, Frank W. Cubbon, Jr., and son of firm President, Stuart F. Cubbon.

KAYLEIGH L. SUMMERVILLE

KAYLEIGH L. SUMMERVILLE is an associate at Cubbon and Associates and has been with the firm since 2021. She was admitted to practice in Ohio in 2017 and in Michigan in 2021. Her practice is dedicated to automobile, motorcycle, and trucking accidents as well as wrongful death claims.


Prior to joining Cubbon and Associates, Kayleigh worked at one of Ohio's largest personal injury firms before starting her own practice, Kayleigh Burden Law. Early in her career, Kayleigh discovered her passion for helping people during their times of need, no matter the circumstances, and is thrilled to have the opportunity to do so everyday as an attorney. Kayleigh is also passionate about helping young lawyers navigate their career paths, frequently mentoring law students and new attorneys, and presenting as a speaker for the Toledo Bar Association's New Lawyer Training course.


Kayleigh grew up in a small town in southeast Michigan and is a proud graduate of Madonna University and the University of Toledo College of Law. She lives in Lambertville, Michigan and coaches the Girls' Basketball Program at Cardinal Stritch High School in Oregon, OH. In her free time, she enjoys traveling, camping, enjoying all aspects of cooking and cuisine, and a good game of euchre, especially if she's winning!
